District court judgment in criminal case no. 1-09-20251

Tallinn District Court judgment of 21 January 2013 upheld in full the judgment
of conviction by Harju County Court of 30 March 2012 in criminal case no.
1-09-20251 (see Tallinn stock exchange press release

AS Merko Ehitus is filing an appeal in cassation within the term of 30 days and
in accordance with procedure set forth in legislation. We intend to challenge
the judgment in full on the basis of material breach of substantive and
procedural norms – on the grounds that the factual circumstances that served as
the basis for the judgment of conviction were established incorrectly as a
result of material violations of procedure. 

The judgment has not entered into force, but the potential financial influence
of the judgment has already been taken into account in the results for AS Merko
Ehitus’s 2011 financial year.
