Court rules in favour of Seamless in Accumulate cases

In October 2013, the Swedish privately held Accumulate AB filed a lawsuit against Seamless Distribution AB for patent infringement. In the lawsuit, Accumulate demanded that Seamless should cease to offer the mobile payment solution Seqr in Sweden. Seamless, which has always rejected any claim for patent infringement, filed a lawsuit against Accumulate in August 2014 where Seamless requested that Accumulate’s patent be declared invalid.

The Patent and Market Court has now given judgment in both cases. In the case of invalidity, the court has ruled that Accumulate patent is to be annulled. Consequently, Accumulate's action against Seamless falls within the infringement action. The Court has nevertheless chosen to adjudicate Accumulate’s infringement action and arrived at the conclusion that, even if the patent would have been valid, Accumulate’s infringement action would still have been dismissed.

"We have always rejected any claim for infringement of Accumulate’s patent and are of course pleased that the Patent and Market Court now confirms that Seamless is innocent of patent infringement," said Tomas Jalling, CEO of Seamless.

"The Court decision to annul Accumulate’s patent is not surprising, we have always considered the patent to be incorrectly founded," continues Tomas Jalling.
