Arctic Gold AB (ARCT): Fylkesman's statement about municipality of Kautekeino's previous decision regarding the Planprogram for Bidjovagge

The Fylkesman in Finnmark has now concluded that none of the five indicated members of the Kautekeino municipal government had a conflict of interest when Arctic Gold's application for Planprogram (investigation study) was rejected on April 26, 2012. The Fylkenman also states that the municipal government had the right to reject Arctic Gold's application at the same meeting.

Arctic Gold's modified application will be processed by the municipal government on December 10, 2012.

The Fylkesman in Finnmark was assigned the task of revieweing whether there was any conflict of interest with five indicated members of the municipal government and whether there was a factual error at the first meeting when the municipal government rejected Arctic Gold's proposals for investigation study. The Fylkenman writes in his review that the five members, who all are reindeer herders or closely related to such, and who are active in the Bidjovagge area, do not have a conflict of interest because they only constitute a fraction of all reindeer herders affected in the area.

The Fylkesman's opinion is that the municipal government did not commit any error when Arctic Gold's application was rejected on April 26 of this year. The Fylkesman quotes what a senior advisor (not a lawyer) at Miljödepartementet (Environmental Protection Agency) writes after an interpretation of the law of impact studies (konsekvensutredningar).

In other words, after the Fylkesman's review, the decision of April 26 to reject Arctic Gold's application remains. Arctic Gold's modified application will be processed by the municipal goverment on December 10, 2012.
