Alimak trademark infringement and use of fake plates in Australia
The Alimak trademark has a global strong reputation in the industry for safety and reliability. Therefore, Alimak has taken immediate legal action against an Australian third party, which has infringed Alimak’s trademark. The infringement was made by attaching fake Alimak branded plates on safety devices, and thereby falsely claiming that certain repair services were carried out by Alimak.
All Alimak products, parts and components are designed and rigorously tested to make sure they work in accordance with the manuals, certifications and instructions distributed by Alimak, as well as ensuring that Alimak products work successfully and safely in the operating conditions for which they are designed.
“At Alimak, we put a lot of effort and pride in making sure that our products are serviced and repaired by competent and authorized service engineers, to ensure reliability and safety. Therefore, it was important for us to take legal action against the non-authorized company using false Alimak plates and thereby also misleading customers,” said David Batson, EVP Construction at Alimak Group.
The Safety device on an Alimak hoist is the ultimate and number one safety function on the hoist.
The company’s global reputation has been built on the principles that Alimak products are designed as a complete system and used in accordance with manuals and instructions distributed by Alimak as the manufacturer.
In view of the above, Alimak took immediate legal action upon finding false Alimak plates which had been applied on Alimak Overspeed Safety Brakes. This infringement action was carried out by an Australian company, which did not have any approval or authorisation from Alimak whatsoever.
The Australian company in question has now complied with Alimak’s legal requirements which included the publication of a correction notice on its website as well as destruction of false plates.
To maintain full safety and functioning of Alimak products, Alimak recommend its customers to ensure that all repairs and services are carried out by authorised Alimak service engineers.
