Ministry of Justice and Public Security is uncertain if a Municipality has to accept and decide upon a Planprogram

The Ministry of Justice and Public Security in Norway has answered on the request from the Ministry of the Environment with regards to what the Plan- og Byggningsloven say regarding if a Municipality has to accept to and decide upon a Planprogram or not.

From the answer it seems like the department is uncertain if a Municipality has to accept and decide upon a Planprogram from a private company aiming to carry through impact studies for a Reguleringsprogram.

Arctic Gold has waited a long time for Kautokeino Municipality to get the support from The Ministry of Justice and Public Security regarding how the Ministry of the Environment should handle the case. The request of support came from the Municipality in order for them to be able to decide upon our modified Planprogram.

The Ministry of Justice and Public Security states among others ”Under tvil er vi kommet til at en kommune antakelig ikke har plikt til å fastsette planprogram for en privat planlegging av en detaljregulering i tilfeller der kommunen ikke ønsker det påtenkte tiltaket”.

-          Presently we are unaware how the Ministry of the Environment and the Municipality will handle the issue however according to our understanding the law and the interpretation of it seems to be flexible and that our case could only be handled through political decisions says, CEO Lars-Åke Claesson.

-          This uncertainty is unacceptable for mining projects and we find it difficult and frustrating. If Norway wants new investments, this uncertainty must be solved says, Chairmen Krister Söderholm.
