Eniro´s disputes with Gulan is finished
Eniro has reached a settlement on the matter regarding the infringement of Eniro’s rights by TeleDanmark’s (TDC) Swedish subsidiaries. The infringement has taken place through the publication of the “Gulan” telephone directory in the Swedish market. TDC’s Swedish subsidiaries have agreed to cease to infringe Eniro´s rights to the “Gula Sidorna” database on the Internet and to the “Gula Sidorna” trademark.
In February 2001, Eniro instituted legal proceedings against TeleDanmark’s Swedish subsidiaries, among other Gulan AB (later namned TDCF Förlag AB and TDCF Försäljning AB, below called TDCF) on the grounds of infringement of Eniro’s rights to the “Gula Sidorna” database on the Internet and to the “Gula Sidorna” trademark and related breach of the Swedish Marketing Act.
Since TDCF now have declared them willing to undertake certain measures as a result of the disputes, Eniro has agreed to withdraw its claim in the three cases. TDCF’s undertaking entails that:
- TDCF undertakes to cease to infringe Eniro’s right to the (pursuant to §49 of the Swedish Copyright Act) protected material in the “Gula Sidorna” directory on the Internet by producing copies of or making available to the public the classified section in the “Gulan” publication containing the headings included in the classified section.
- TDCF undertakes to cease to infringe Eniro’s right to the (pursuant to §1 and §49 of the Swedish Copyright Act) protected classified headings in “Gula Sidorna” on the Internet by producing copies of or making available to the public the classified headings in the “Gulan” publication.
- TDCF undertakes to not use “Gulan” as a trademark, a company name, domain name or other distinctive mark in the future.
- TDCF undertakes not to use the name “Gulan” or any other distinctive mark that may be confused with “Gula Sidorna” in its future marketing.
TDCF’s undertaking is subject to a fine. In addition to TDCF’s undertaking, TDCF shall pay compensation to Eniro. The parties have agreed not to publicly announce the financial amounts involved in the settlement.
