Exel wins dispute at Kouvola Court of Appeal – One Way Sport Oy’s precautionary measure overruled

Due to inquiries we wish to inform that Kouvola Court of Appeal has on 1 February 2007 rendered a decision regarding One Way Sport Oy’s precautionary measure against Exel. The injunction concerned a hangtag attached to xc-ski poles displaying Raphaël Poirée as a reference for a new product. The new product was launched in 2005/2006 season when Exel and Poirée had an agreement. The hangtag in question was designed and printed during the agreement period between Exel and Poirée. Kouvola Court of Appeal overruled the injunction of Heinola District Court where Exel was, among other things, required to remove the said hangtags from the poles delivered to retailers.

Aki Karihtala, Senior Vice President of Exel’s Sport Division says that the decision is just and expected. Karihtala thinks it is most regrettable that One Way Sport Oy decided to take the matter to court. The decision is in line with common practice relating to athletes’ and their sponsors’ cooperation when an athlete changes sponsors.
