Market Court dismisses penalty payment proposed for Onninen Oy

The Finnish Competition and Consumer Authority investigated actions by Kesko Group company Onninen as well as several other companies in the HPAC infra plastic pipe product market for nearly a decade. The investigation concerned events between 2009 and 2016. Kesko was aware of the ongoing investigation when it acquired Onninen in 2016. Kesko has not at any point of the investigation been suspected of violations. 

The Finnish Competition and Consumer Authority (FCCA) initiated an investigation into the HPAC infra plastic pipe product market in Finland in 2013, concerning a wide range of companies operating in said market. In 2022, the FCCA eventually decided to take the matter to the Market Court, and proposed that a penalty payment be imposed on Onninen.  

In its decision on 28 August 2024, the Market Court dismissed the penalty payments proposed for Onninen and the other companies. In addition, the Market Court ordered the FCCA to reimburse Onninen for litigation costs.
