Court of Appeals Dismisses Lawsuit Against Montgomery College Board of Trustees

The Court of Appeals of Maryland has granted Montgomery College's motion to dismiss the lawsuit filed by Judicial Watch against the Montgomery College Board of Trustees. The lawsuit challenged the College's former tuition policy, which granted the lowest tuition rate to all recent county high school graduates within three years of their graduation date.

The College's new tuition policy became effective on December 6, 2012 after the passage of the referendum on the Maryland Dream Act in the November election, to follow the requirements of the new state law, Section 15106.8 of the Education Article. Known as the Maryland Dream Act, the law allows eligible high school graduates who are undocumented immigrants to qualify for the lowest tuition rates at public colleges and universities within the state of Maryland.

In its decision, dated December 18, 2012, the Court of Appeals dismissed the case on the grounds that the lawsuit was moot with the passage of the Maryland Dream Act. As a result, Montgomery College will continue its longstanding tradition of providing affordable, accessible higher education to Montgomery County high school graduates who are undocumented immigrants.
