Restamax Plc summoned to Market Court

Restamax Plc has been served notice of a lawsuit by which it has been summoned to Market Court. The plaintiff in the case is Hansamix Oy from Kemijärvi, which claims that Restamax's Flame restaurant in Tampere has violated a trademark registered to Hansamix. For the violation of the trademark, the plaintiff is demanding EUR 300,000 in compensation and EUR 180,000 in damages, as well as a ban on the use of the Flame name/symbol in business under threat of a EUR 100,000 fine. The plaintiff also alleges that with its Flame restaurant, Restamax is guilty of unfair imitation forbidden under the Unfair Business Practices Act.

The name Flame is no longer in use in Restamax's business. In Restamax's view, the demands set forth by Hansamix Oy are completely groundless in terms of both their justification and amount, and they will be denied in a response given to the Market Court.
