Pergo® welcomes initial determination in click-joint case in the u.s.

PERGO® WELCOMES INITIAL DETERMINATION IN CLICK-JOINT CASE IN THE U.S. The Pergo Group has received a favorable initial determination in the click-joint case from the Judge in the U.S. International Trade Commission (ITC). On November 2, 2001 an Administrative Law Judge (ALJ) in the ITC issued an initial determination in which he found that a Pergo laminate flooring product with a specific type of click-joint and its installation instruction do not infringe certain patents owned by Välinge Aluminium AB. The Pergo product in question in the ITC case is a laminate flooring product with a glue-less click-joint licensed by the Belgian Unilin Group. A final determination from the ITC is expected at the latest February 5, 2002. If the ITC affirms the ALJ's determination, Pergo will be allowed to continue importing into and selling in the U.S. the product with the existing installation instruction. The ITC instituted the investigation on December 29, 2000 based on a complaint filed on behalf of Alloc Inc, Berry Finance N.V. and Välinge Aluminium AB. The six respondents included in the ALJ's determination are Pergo Inc., Unilin Décor N.V., BHK of America, Inc., Meister-Leisten Schulte GmbH, Akzenta Paneele + Profile GmbH, and Roysol.
