Under Valued Divorce Settlements Reveal Thousands of Pounds May be Recovered for Over 750,000 Divorcees Across the UK

More than 750,000 divorcees across the country may be entitled to claim back thousands of pounds after their divorce settlement was undervalued at the time of their divorce. This is according to Divorce LifeLine, a divorce and pension consultancy that is helping affected divorcees claim back their money from their former solicitors.

Following a major change in the Law in 2000, Divorce LifeLine has estimated that up to half of the 1.5 million divorces that have taken place in the UK since the law was changed may have not had their divorce settlement correctly valued by a financial expert. Many divorcees therefore could have lost tens of thousands of pounds.

Divorce LifeLine is now working with divorced women throughout the country to find out whether or not their divorce settlements were undervalued. Where they are, Divorce LifeLine pursues a case on the divorcee’s behalf, against their former solicitors, without involving the former spouse at all.

Tony Derbyshire, co-founder and partner of Divorce LifeLine commented: “Divorce is one of life’s most stressful events and divorcees can do without the added stress of their divorce lawyer neglecting to protect their clients’ best interests. This is about ensuring divorcees are treated fairly and receive the true settlement they were entitled to. This process has nothing to do with the former spouse who is not involved in the claim process at all.”

With disposable household incomes dwindling and child benefit cuts underway, this news is already proving extremely valuable to many divorcees who are struggling to make financial ends meet in what is a challenging economic climate.

According to Derbyshire: “Helping clients recover from the financial loss they have suffered is extremely satisfying. We have just taken an enquiry from a lady in Bolton, who we are confident we will be able to recover over £135,000 for. Another lady in Dorking called us today, and after carrying out some preliminary inquiries, we have already ascertained that her divorce settlement may have been under-valued by more than £60,000.”

As pensions are such complex financial assets, calculating the true value of a pension in a divorce settlement is difficult. It is easy to get the pension value wrong without the expert advice of an independent financial advisor (IFA) or actuary, and divorce lawyers often seem to have done just that.

Derbyshire explains: “If a Picasso was a matrimonial asset, the best expert advice would of course be obtained to get to the true value of it. A pension is a lot more complex an asset, yet extraordinarily, it is an asset that is usually under valued, and often by an inappropriate ‘expert’; and this is where we can help.”
