Church & Dwight Inc. Sued for False Advertising

Church & Dwight Inc. is being sued in a consumer fraud lawsuit claiming the company falsely uses the word “natural” in its promotion of a deodorant, which allegedly contains man made materials.

According to the New Jersey Law Journal (subscription required), Stephen Trewin and Joseph Farhatt filed their class action lawsuit on March 9, 2012. They claim that the promotion of Arm & Hammer Essentials Natural Deodorant falsely suggests that the product contains only natural ingredients. The lawsuit also alleges that the company charges 12 cents more for the deodorant than its other Arm & Hammer deodorants.

The consumer fraud lawsuit states that the promotion “implies to a reasonable consumer that the defendant's product contains only natural ingredients. Given that defendant's product includes synthetic ingredients, the [product label] is false and misleading."

The lead plaintiffs allege that Church & Dwight violated Missouri’s Merchandising Practices Act, New Jersey’s Consumer Fraud Act and breach of implied warranty.
