Discover Hit With Consumer Fraud Lawsuit

The lead plaintiff in a class action consumer fraud lawsuit againstDiscover Bank claims the company used false credit card “agreements” when it pursued litigation against its customers.

According to Courthouse News, lead plaintiff Diana Elinich claims she received a Discover credit card in 1999, but when the bank sued her for defaulting on her payments, it produced a “cardmember agreement” with a 2011 date as evidence in court. She alleges that Discover attempted to attach false or “otherwise irrelevant documentation as exhibits” to collection lawsuits in order to intimidate unsuspecting consumers.

Elinich seeks damages for violations of the Fair Debt Collection Practices Act, RICO violations, deceptive trade, and state consumer protection law.
