Nursing Home Abuse Charges Levied by California Attorney General

California Attorney General Kamala D. Harris has charged a vocational nurse and the former Director of Nursing at the El Dorado Care Center after they allegedly failed to monitor a patient who passed away due to their negligence.

According to the Sacramento Bee, 58-year-old Donna Darlene Palmer – the former nursing director – and 38-year-old Rebecca LeAn Smith – the nurse – were both arrested last week following the reopening of an investigation into the 2008 death of Johnnie Esco, who had been a patient at the facility.

Esco’s situation had been the subject of a number of many investigations since her March 7, 2008 death. After being diagnosed with Alzheimer’s Disease that worsened over time, she developed chronic constipation that required monitoring. She entered the El Dorado nursing home to recuperate from Pneumonia and was scheduled to return home in one month.

However, investigations revealed that Esco’s bowel movements and mental condition were not properly monitored by Smith. Esco eventually suffered severe fecal impaction and passed away.

Bruising along her chin, jaw line, chest, and right wrist were also discovered, as was a tear on the skin of her pinkie finger. The nursing staff allegedly did not “properly document and investigate” these injuries.

Palmer is also accused of creating a working environment of "intimidation and hostility that made staff reluctant to question [her] judgment," according to a Department of Justice agent report.

Both Palmer and Smith are being charged with felony elder abuse and could face up to four years in prison if convicted.
