Wrongful Birth Lawsuit Leads to $3 Million Award

A jury awarded close to $3 million to an Oregon Couple in a wrongful birth lawsuit that claimed their daughter was born with Down syndrome even though a prenatal test showed that she did not have the chromosomal abnormality.

According to The Oregonian, Deborah Levy filed her wrongful birth lawsuit against the Legacy Health System and claims that she would have terminated her pregnancy if she knew her daughter was going to be born with Down syndrome. The lawsuit claims that Legacy’s Center for Paternal-Fetal Medicine and Legacy Lab did not take the proper steps to perform her test correctly.

The jury found that the employees at Legacy Health were negligent in her prenatal tests by taking too small of a sample from Levy’s womb for it to be useful.
