A $40 million settlement in a consumer fraud lawsuit against Skechers USA Inc. has been tentatively approved by a federal judge.

The consumer fraud lawsuit claims that the company made unfounded advertising claims that its toning shoes would help people slim down and strengthen their muscles, according to the Associated Press (AP).

The settlement will allow consumers to get a maximum repayment for their purchases of up to $80 per pair of Shape-Ups, $40 per pair of Tone-Ups, up to $54 per pair of Podded Sole Shoes, and $84 per pair of Resistance Runner shoes, according to the AP.

More than 70 lawsuits from across the nation were consolidated in federal court in Louisville, Kentucky.

While denying the allegations, Skechers said it settled to avoid a lengthy court battle.
