Apple Sued in Consumer Fraud Lawsuit Over iPhone 4s

Apple is being sued in a consumer fraud lawsuit by a consumer alleging the company’s iPhone 4S does not operate as it is promoted.

According to Courthouse News, Frank Fazio filed his class action lawsuit claiming the commercial for the voice-activated “Siri” feature on the iPhone 4 did not perform as advertised. He alleges that when he asked Siri for directions to a location, it did not recognized what he was asking for or after waiting for a long time, responded with an incorrect answer.

He further claims that he “would not have paid the price he paid for theiPhone 4S, had had he not seen these representations.”

The consumer fraud lawsuit states “defendant's misrepresentations concerning the Siri feature of the iPhone 4S are misleading, false, and reasonably likes to deceive and have deceived plaintiff and members of the putative class."

Fazio seeks restitution, compensatory and statutory damages for intentional misrepresentation, breach of warranty, negligent misrepresentation, violations of California consumer law, and unfair competition.
