Birth Injury Lawsuit Brought Against Doctor

A California family with a three-year-old daughter who was born with cerebral palsy is alleging that the doctor who handled the birth committed malpractice and led to the development of the birth injury.

Jennifer Blunt arrived at Sierra Vista Regional Medical Center on April 19, 2009 to give birth. However, problems arose when the heart rate of her child dropped significantly in the minutes before birth. As a result, her child Sofia was born with cerebral palsy and severe brain damage.

Jennifer, and her husband Andrew, allege in the subsequent birth injury lawsuit that Dr. Kurt Haupt – the doctor who performed the birth - should have expedited the birth and potentially prevented the drop in blood pressure.

“Dr. Haupt didn’t do anything significantly different to expedite the delivery of the baby,” the plaintiffs’ the court documents state, according to The San Luis Obispo Tribune. “Dr. Haupt did not employ a vacuum or forceps to expedite delivery nor did he discuss such procedures with Mr. Blunt.”

Because of Sofia’s birth injuries, she requires regular medical care that could cost up to $50 million over the course of her lifetime. The Blunt’s birth injury lawsuit is seeking up to $20 million in damages.
