Birth Injury Lawsuit Results in $55M Award

A Maryland family has won $55 million following their birth injury lawsuit that was filed against Johns Hopkins Hospital that claimed medical negligence led to their child’s severe birth injuries.

In March 2010, Rebecca Fielding was to to give birth to her son with a midwife. However, during the pregnancy the baby suddenly became stuck, requiring her to be rushed to Johns Hopkins by ambulance.

"It was a real nightmare for me. I was in the second stage of labor. I was pushing involuntarily. My body just wanted to get the baby out. The contractions were overwhelming. I was exhausted. It was a very hard time for us," said Fielding, according to WBAL-AM.

Upon arriving at the hospital, Fielding was told she would undergo a Caesarean section immediately. However, she then proceeded to wait for two hours until the procedure was actually performed.

The child, Enzo Martinez, was eventually born but suffered severe birth injuries. He still suffers from severe developmental disorders. It only took a jury three weeks to determine that the hospital was at fault for Enzo’s birth injuries because doctors waited too long to perform the emergency C-section.
