Cerebral Palsy Lawsuit Leads to $9M Award

A Virginia jury awarded $9 million to a couple in a cerebral palsy lawsuit that claims two doctors are liable for their child’s birth injuries.

Marsha Simpson claims that during the 2001 birth of her daughter, two doctors from the Southwest Virginia Physicians for Women were negligent in her care, according to The Roanoke Times. She claims that one doctor gave her unnecessary treatments such as an amniocentesis to see if her lungs were functioning and did not inform her prior to deciding to use the treatment. Simpson further says that the doctor failed to recognize complications before another doctor treated her.

The cerebral palsy lawsuit claims that the second doctor ordered Simpson’s labor to be induced without her consent. During the trial, an expert witness said that she should have undergone a Caesarean section. The complaint says that this action was negligent and that the doctors should have taken swifter actions when complications arose.

Simpson’s daughter was born with extremely low blood pressure, massive blood loss, and her kidneys were destroyed. The infant also sustained a brain injury because of a lack of oxygen, which led to cerebral palsy, according to the complaint.
