Cosmetic Companies Sued Over Animal Testing

Five women have sued cosmetic companies in a class action consumer fraud lawsuit claiming their products were not tested on animals when animal testing was in fact done in China.

According to Courthouse News, the complaint was filed against Avon, Estee Lauder, and Mary Kay and states that the companies advertised and marketed their products as being “cruelty free” when they in fact were testing on animals in foreign countries. The plaintiffs claim that "as a result of being included on the list, as well as many similar lists, defendants enjoyed the support of PETA and millions of consumers who buy cosmetics only from companies that do not conduct animal testing.”

The complaint also states “Defendants later purported to disclose, at least on their websites, that they in fact were animal testing, but the disclosures were wholly inadequate and deceptive."

The plaintiffs seek damages and an injunction for fraudulent concealment, false advertising, unfair business practices, and violations of California’s Consumer Legal Remedies Act.
