Court Affirms Award in Birth Injury Case
The Superior Court of Pennsylvania affirmed on appeal a jury’s decision to award $2.2 million to a couple who alleged that their child’s cerebral palsy was the result of medical negligence during delivery.
Law360 (subscription required) reports that plaintiffs sued the Hospital of the University of Pennsylvania and the consulting physician for allegedly causing their baby’s cerebral palsy during delivery. The hospital and the consulting physician deferred delivery by C-section despite evidence of complications that caused the fetus to be deprived of adequate oxygen for more than 15 minutes, allege the plaintiffs.
The baby died at 17 months due to complications from cerebral palsy.
The hospital and the physician appealed the jury award, but the appeals court rejected their appeal saying the trial court had not abused its discretion or erred in awarding the damages, according to Law360.
