Court Rules Girl With Cerebral Palsy May Attend Trial

The Georgia Supreme Court ruled that it was wrong for a judge to exclude a girl from her own trial over a cerebral palsy lawsuit. The judge excluded the girl in an effort to keep the jury from being emotionally swayed by her mental and physical disabilities.

Thirteen-year-old Kyla Kesterson has severe cerebral palsy confining her to a wheel chair, which requires her to have her airway suctioned several times each day. Kyla also has a feeding tube inserted into her stomach, has frequent seizures, has limited cognitive function, and is unable to speak, according to The Atlanta Journal- Constitution. Her parents filed a cerebral palsy lawsuit on her behalf.

In the initial 2008 trial, the jury ruled in favor of the doctor, but because Kesterson was not allowed to be present for most of the trial, the case will be retried.
