GoDaddy Faces Lawsuit over Server Failure

GoDaddy.com LLC is facing a possible class-action consumer fraud lawsuit because a server failure the company suffered earlier this month is alleged to be a violation of its promise that its website services would be available 99.9 percent of the time.

Law360 (subscription required) reports that GoDaddy touts its website services with a guarantee of 99.9 percent uptime, which is the time that the website is supposed to be running. To maintain the guarantee, the services can only go down for about 43.2 minutes per month, according to the complaint. On September 10th however, its servers went offline for 6 hours and instead of compensating customers for the loss, the company sent them coupons for its other products.

Plaintiff and customer Eric Mitchell alleged that he and other customers suffered interrupted services, damage, and financial loss due to the server failure, writes Law360. He also said that the discount coupons offered by the company were inadequate compensation for the loss.

Mitchell asked for unspecified compensation for a class expected to comprise at least one million customers.
