Historic Mesothelioma Ruling in Japan

It may have occurred in Japan, but a historic mesothelioma lawsuit ruling has ordered a company that caused the mesothelioma death of a man who lived near its facilities to pay a monetary settlement.

According to The Daily Yomiuri, a district court in Kobe recently rules that Kubota Corp. will pay close to 32 million Yen (approximately $400,000) to the family of Kojiro Yamauchi, who worked near the company’s Amagasaki factory for 20 years and passed away from pleural mesothelioma.

A mesothelioma lawsuit was filed by Yamauchi’s family, and another family with similar charges, against Kubota that claimed his mesothelioma diagnosis had been caused by asbestos released from the company’s factory. The families had initially asked for 79 million yen from Kubota and the government.

The ruling is notable because it marks the first time a Japanese court has ruled that a company is responsible for asbestos-related damages that extend beyond its factory walls.
