Hyundai Sued in Consumer Fraud Lawsuit

Hyundai Motor America was sued in a consumer fraud lawsuit that claims it misled consumers about the gas mileage of some of its Elantra vehicles.

Consumer Watchdog filed the complaint and claims that Hyundai marketed the 2011 and 2012 Elantra sedan as “The 40 Mile Per Gallon Elantra” without informing consumers that the 40 mpg estimate was for highway driving only, as required by the government, according to The Sacramento Bee. The federal mileage estimate for this type of vehicle is 29 miles per gallon.

The consumer fraud lawsuit also says that Hyundai’s “illegal” advertisements led “tens of thousands of California drivers” to buy or lease 2011 and 2012 Elantras and incur more costs for gas than expected.

The plaintiffs want Hyundai to stop advertising gas mileage numbers without government-mandated disclosures and ask for damages on behalf of California residents who purchased the Elantras, according to The Sacramento Bee.
