Jury Awards $9M for Tooth Removal Gone Wrong

A 49-year-old man was awarded damages of $9.8 million by a New York state jury for injuries sustained during a bungled wisdom tooth extraction.

The plaintiff consulted Dr. William Moody for a toothache, according toPR News Wire. Dr. Moody made three attempts to extract the tooth, assumed the extraction was complete, and then sent the man home.

However, after returning home, the man had to be rushed to the Emergency Room at White Plains Hospital and then transferred to Westchester County Medical Center where he was placed under the care of an oral surgeon, Dr. Michael Miller.

Dr. Miller diagnosed him with air emphysema and residual roots and surgically extracted the residual roots. However, Dr. Miller never ever examined the plaintiff before the surgery, reports PR News Wire.

The plaintiff is now not able to resume his work as a hydro-geologist due to the constant pain from the dental procedures.

The jury held both Dr. Moody and Dr. Miller liable for the injuries and also for their failure to obtain an informed consent from the plaintiff.
