Lawsuit Against eBay Insurance Exclusions

Auction website eBay is facing a proposed class action consumer fraud lawsuit in a California federal court alleging it offers insurance to its sellers that does not cover the items being shipped -- and does not disclose that when they buy the insurance.  

Courthouse News Service reports lead plaintiff Luke Knowles alleges that eBay’s ShipCover insurance does not cover the entire range of products sold under the auction site’s categories, which are set by eBay. This fact is allegedly hidden from the customers who buy the insurance policy as it does not appear on the checkout page where other insurance information is disclosed.

In the complaint filed against eBay, eBay Insurances Services, Brown & Brown of Missouri, and Fireman's Fund Insurance Co., Knowles claims that eBay knowingly offered insurance on items specifically excluded from ShipCover by virtue of eBay's listing system, reported Courthouse News Service.

He further claims eBay shares in the profits generated by ShipCover.

Knowles says that if he would have known about the exclusions, he wouldn’t have bought the insurance.
