Medical Malpractice Lawsuit Filed Against CA Hospital

A medical malpractice lawsuit has been filed against the University of California-San Diego Medical Center by a man claiming he received a cancerous kidney transplant.

Austin Scalf claims that even though he signed a paper saying he did not want a kidney from a person had health issues, his doctor still gave him a kidney with a cyst, according to ABC affiliate 10 News. He says that a biopsy showed that the organ was cancerous and he later found out that the kidney’s donor was from a 52-year-old diabetic with high blood pressure. He also discovered that the man smoked both cigarettes and marijuana for 10 years.

The medical malpractice lawsuit claims that the doctor and the UC Regents were negligent by not doing a biopsy on the kidney before it was implanted.

The diseased kidney was removed but led to the creation of antibodies in Scalf’s blood that caused his body to reject another kidney transplant from his brother, according to the complaint. The surgery also led to complications that almost caused Scalf’s death.
