Medical Malpractice Lawsuit Leads to $28.4M Award

A Florida jury awarded $28.45 million to a child who suffered brain damage after he was misdiagnosed at an area hospital.

Dens Pierre Normil was brought to Bethesda Memorial Hospital in 2006 with a high fever and according to a lawsuit filed by his mother, doctors ignored the results of a spinal tap that showed he was suffering from meningitis – an infection of the membranes covering the brain and spinal cord, according to the Palm Beach Post. During the trial, experts testified that had the infant been treated with the appropriate antibiotics, the infection would have cleared.

The medical malpractice lawsuit alleges that the 10-month-old had a stroke that destroyed parts of his brain and he has the mental capacity of an 18-month-old, according to the Palm Beach Post.

A Florida state cap on non-economic damages may cap the $12 million award to $1 million. The Florida Supreme Court is currently evaluating the legality of the caps.
