Medical Malpractice Lawsuit Leads to $5.2M Award

A California jury awarded $5.2 million to a woman who claimed she was disfigured because of the medical negligence of the doctor for the San Diego Chargers football team.

Plaintiff Whitney Engler, had knee surgery in 2003 and to aid in her healing after the procedure, her doctor prescribed a cold-therapy device called Polar Care Unit made by Berg Inc., according to USA Today. However, the doctor, who is also the Charger’s physician, failed to inform her that the medical device previously caused injuries to patients or that his company benefited financially from the product, according to the complaint.

The medical malpractice lawsuit claims that Engler suffered frostbite from the medical device, which led to permanent disfigurement and other injuries, according to USA Today.

The jury’s award represents compensatory damages, including future economic damages, and payment of pain and mental suffering. The verdict found both the doctor and Breg liable for damages.
