Medical Negligence Caused Birth Injuries to Mother and Son

An Iowa woman and her husband have brought a birth injury lawsuit against the state after a botched C-section delivery at one of the state-run hospitals injured both she and her newborn son.

Jody Schmitz arrived at Iowa City Hospital on February 20, 2008 at 4:43 AM in active labor. However, it was not until 2:17 PM that her son Aiden was born via C-section. Jody waited at the hospital for more than eight hours before being wheeled into surgery to give birth, Eastern Iowa News Now reported.

Aiden was born with a skull deformity, a partial skull fracture, and subdural hemorrhages. Jody suffered a laceration to her bladder that became infected and led to a bowel obstruction, pelvic abscess, wound separation, and forced her to use a feeding tube.

In the birth injury lawsuit, the Schmitz claim that the state of Iowa is responsible for the medical negligence of the doctors at the hospital that led to Jody and Aiden’s injuries.

“The UIHC staff negligently failed to promptly and safely deliver Aiden, and failed to promptly take Mrs. Schmitz to the operating room,” the lawsuit states.
