Megabus has agreed to pay $5 million to settle a wrongful death lawsuit filed by the family of a man who was killed by a bus as he crossed a downtown Chicago street in 2010.

Wes Krueger, 64-years-old at the time, was crossing the street when a Megabus struck and dragged him for 30 feet, according to NBC Chicago. He was transported to Northwestern Memorial Hospital where he died soon after.

The wrongful death lawsuit claimed that the driver of the bus, Shervyle Pruitt, failed to pay proper attention to the road, sound the horn, yield the right of way, obey traffic signals, and slow down to avoid hitting Kreuger, according to NBC Chicago.

This settlement comes one day after a Megabus killed a 76-year-old woman near the same area.
