Nestle Sued in a Class Action Consumer Fraud Lawsuit over Baby Food

A New York woman has filed a class action consumer fraud lawsuit claiming Nestle USA, Inc. and Gerber Products Company made overinflated claims about their baby food.

Saba Siddigi filed her complaint in California federal court and claims that the companies overstated the benefits of their baby food by stating that the products are formulated specially for babies’ nutritional and developmental needs, help support eye and bran development, and contain the same ingredients contained in breast milk.

The consumer fraud lawsuit claims that the Nestle and Gerber’s advertising is deceptive because it implies that their products containing pre-biotics and pro-biotics are healthier than other baby food alternatives - and, charged more for them - without scientific evidence to support these claims. She further alleges that most scientists agree that pro and pre-biotics may harm developing children.

Siddigi seeks damages under the state consumer protection statues.
