New York Investigates Energy-Drink Makers

A spotlight has been put on energy-drink makers by New York’s attorney general, who is probing whether the industry is misleading consumers about the health benefits and ingredients of the products.

New York Attorney General Eric Schneiderman issued subpoenas in July to Monster Beverage Corp., PepsiCo Inc., and Living Essentials LLC, asking them for information on their advertising and marketing practices, according to the Wall Street Journal. This move has caught the attention of many because the drinks are among the fastest-growing products in the beverage industry.

In 2009, the Food and Drug Administration said it was “concerned” certain ingredients—such as botanical extracts—were being added to beverages and foods, according to the Wall Street Journal.

The New York investigation is focusing on both on misleading labeling and advertising claims and whether the makers of the energy drinks overstate the benefits of the drinks and downplay the effect of caffeine.
