No MDL for Surgical Robot Lawsuits

The Judicial Panel on Multidistrict Litigation (JPML) issued an order denying transfer and coordination of product liability litigation involving Intuitive Surgical’s da Vinci Robotic Surgical System.

The litigation currently consists of four cases pending in four federal districts.

According to the order, the panel was not convinced that centralization of the litigation “would serve the convenience of the parties and witnesses or further the just and efficient conduct of this litigation.” It felt that the cases were fairly straightforward personal injury or wrongful death actions that would turn on individual questions of fact regarding the circumstances of each person’s alleged injuries.
