Nursing Home Abuse Lawsuit Filed in CA
The deaths of two patients at the Lifehouse Cypress Healthcare Center last year led to their families filing two nursing home abuse lawsuits.
The families of Mary Gustavson and Donald Dey Sr. filed two lawsuits against Life House Cypress Healthcare Center and Enloe Medical Center, according to the Chico Enterprise-Record.
The first complaint states that Dey was admitted to Enloe Medical Center for kidney disease and an infection on January 12, 2011. He was then admitted to Lifehouse Cypress on January 17, 2011 and according to the lawsuit “he was assessed by the nursing staff and determined to be at substantial risk of failing.” The family said that Dey was taken to his room, left alone, and found unconscious on the floor with a head injury less than one hour later. He was taken to the hospital and died two days later from swelling of the brain, according to the complaint.
Dey’s family said that he should not have been left alone and that one cause of Dey's fall was the nursing home's failure to hire enough staff to care for patients properly.
The second nursing home abuse lawsuit states that after being at Enloe to treat breathing problems, Gustavson was transferred to Lifehouse Cypress on February 2, 2011 for short-term rehabilitation. Her family said that the nursing home staff gave Gustavson her drugs at the wrong intervals in a day, which led to an overdose. On February 6, she was rushed to Feather River Hospital where the doctor diagnosed her with pneumonia, morphine overdose and kidney failure, according to the complaint. She died of “acute renal failure” on February 24. The complaint says that the overdose of the drugs at the nursing home caused the kidney failure.
The families charge the defendants with negligence, wrongful death and violations of health and safety code.
