Nutrex Faces Class Action Over DMAA

A judge ruled not to grant the request of Nutrex Research to dismiss a pending class action lawsuit it’s defending. The company’s dietary supplement is allegedly produced with an illegal stimulant as an ingredient, DMAA, which incited the lawsuit.

Lead plaintiff Stephen Rush claims that Nutrex violated California’s fair business laws by marketing the supplement as safe when it knew the products were unsafe and ineffective, according to Courthouse News. He alleges that the company’s Hemo Black Rage Ultra Concentrate and Lipo 6 Black Hers Ultra Concentrate caused him and his girlfriend to feel jittery and anxious after six weeks of use. He further says that he didn’t know the supplements contained DMAA and did not know the stimulant could cause stroke or death.

U.S. Magistrate Laurel Beeler refused to dismiss the lawsuit and said that Nutrex failed to directly address the accusations against it in the complaint, according to Courthouse News.
