PA Couple Claim Insurance Company Acted In Bad Faith

A Pennsylvania couple whose home is uninhabitable after a 2011 fire is bringing a bad faith insurance lawsuit against their fire insurance policy holder who has, to this point, refused to properly pay out the claim.

Cherryville residents Gregory and Linda Dombroski took out a one-year fire insurance policy on their home through Lititz Mutual Insurance Company on May 4, 2011. On June 26, a fire broke out in the couple’s bedroom, damaging the roof of their home and destroying a number of personal possessions.

Despite the fire insurance policy the Dombroskis had signed, and the subsequent claim they filed with Lititz to collect the payment they deserved, the insurance company refused to pay. Instead, Lititz hired an investigator and claimed that the fire had been set by the couple intentionally.

The couple said that they did not know the cause of the fire, and added that they have been forced to live in another location since it occurred because of the damage, according to Allentown’s WFMZ-TV. In their bad faith lawsuit they are seeking triple the damages under the Pennsylvania Unfair Trade Practices and Consumer Protection Law, as well as $50,000 and interest from Lititz for acting in bad faith with their claim.
