Panda Express Sued by Employees

A former employee of Panda Express has sued the fast food chain in California for failing to provide seating for its workers claiming that this violated the state’s labor code.

According to Law360(subscription required), Fue Yang alleges that she was not allowed to sit down while she was working as a cashier and counter server at the company. She claims that this is a violation of the California Labor Code and Wage Order 7-2001, which states that “all working employees shall be provided with suitable seats when the nature of work reasonably permits.”

Yang seeks class action status to represent all the counter servers and cashiers that worked for the company.

Other companies who have been sued with similar claims are Rite Aid Corp., GameStop Corp., and Nordstrom Inc.
