Personal Injury Suit Leads to $32M Award

A California jury awarded more than $31.5 million in a personal injury lawsuit to a man who was severely injured after a motorcycle accident.

On April 29, 2009, plaintiff David Evans was hit by a vehicle turning left at an intersection at Highway 138 and Mountain Road, according to the Contra Costa Times.

The personal injury lawsuit claimed that the intersection was “skewed” and was even given nicknames such as “Death Highway” and "Bloody Alley” because of the danger it posed to drivers, according to the Times.

Evans suffered severe brain and spinal cord injuries and will need 24-hour care for the remainder of his life.

The evidence in the lawsuit found that the chief of operations for Caltrans, the state agency responsible for highway, bridge, and rail maintenance, received a complaint from a local citizen about the road more than one year prior to the accident.
