PVC Deck Makers Sued Over Durability Claims

A consumer class-action lawsuit challenges the durability claims made by the makers of AZEK cellular PVC decks.

Law360 (subscription required) reports the class action alleges that CPG International Inc. and AZEK Building Products Inc. falsely market their cellular PVC decking material as longer-lasting when compared to decks of wood and composite material. The suit claims that the PVC decking has design and construction defects, resulting in premature deterioration and also loss of structural integrity.

Law360 writes that the plaintiffs say they had invested in the PVC decking believing the claims of durability. Plaintiffs state that the members of the class have paid steep prices to replace the decking and that potential damages may be in excess of $5 million.

CPG and AZEK tried to pacify consumers by offering after-market products to correct the alleged defects, according to the suit. The companies allegedly violated New York general business law and breached express and implied warranties, and the plaintiffs are seeking compensatory damages, reports Law360.
