Waiters Allege NY Yankees Pocketed Service Charges

Yankee Stadium waiters are suing a food service company and the team’s operating company for allegedly pocketing the 20 percent service charge levied on the food delivered to baseball fans sitting in the ballpark’s premium seats.

Food service provider Legends Hospitality LLC allegedly kept the service charge from 2009 through to the 2011 season instead of passing it on to the workers, according to Law360 (subscription required). 

According to the suit, the mandatory 20 percent charge was removed from the menu at the beginning of the 2012 season because it violated the law. Any such mandatory charges are assumed to be tips and should be passed to the workers, according to New York labor laws.

Legends is owned by the Yankees, the Dallas Cowboys, and Goldman Sachs.  It earned $25 million annually by serving food to baseball fans sitting in premium seats, writes Law360.

The New York Yankees Partnership was also named in the suit, which was brought by plaintiff Janine Mendez along with 32 co-workers.  

The complaint seeks payment of unpaid wages, damages, and interest.
