The family of a Washington man has filed a wrongful death lawsuit against the Reno Air Racing Association Inc. regarding the September 2011air show crash that killed 10 people and injured 70 others.

According to The Reno Gazette-Journal, Gregory John Morcum’s family filed their complaint in Reno District Court claiming that the racing association was negligent in promoting and holding an event that turned out to be unsafe. The complaint also claims that the pilot and others who took part in the show modified the World War II race plane that ended up crashing without knowing how it would perform at extremely high speeds and “without due regard for safety and well being of pilots and spectators.”

The wrongful death lawsuit is the latest in a number of legal actions being taken against the racing association and others tied to the incident.
