Wrongful Death Lawsuit Leads to $15M Award

An Alabama jury awarded $15 million in a wrongful death lawsuit to the family of a woman who died after being given an overdose of an anesthetic after a major surgery.

On November 7, 2008, Theresa Oden successfully underwent triple bypass heart surgery at Spring Hill Medical Center and was recovering without any complications, according to the Mobile Press-Register. However, a new nurse gave Oden too much of the anesthetic Propofol, and about 25 minutes later she suffered cardiac arrest and fell into a coma, according to the complaint.

The wrongful death lawsuit also said that the nurse attempted to mask her mistake by making changes to Oden’s ventilator and vital signs settings in the hospital chart. It further said that the nurse violated the hospital’s policy by throwing out the rest of the drug and deleting the computer memory from the drug pump, according to the Press-Register.
