Wrongful Death Lawsuit Leads to $29M Award

The Burlington Northern Santa Fe Railroad (BNSF) has agreed to pay a record $29.1 million in a wrongful death lawsuit to the families of four young people killed during a 2003 automobile accident.

The wrongful death lawsuits claimed that the driver of a BNSF freight train—traveling 60 miles per hour—ignored a warning and tried to beat the crossing signal, when it crashed into Brian Frazier’s vehicle as it crossed the tracks, according to the Minneapolis Star Tribune. The families claim that the gate was not functioning properly.

The settlement is one of the largest wrongful death lawsuit settlements to ever be handed down in Minnesota.
