Wrongful Death Lawsuit Yields $9M Award

Arkansas State agreed to pay $9 million to settle a wrongful death lawsuit filed by the family of a man who died in a fiery accident after a truck driver had a seizure and drove into on-coming traffic.

The wrongful death lawsuit was filed by the two adult sons of Roy Johnson Jr. The incident allegedly occurred while their father was travelling eastbound on Interstate-40.

The driver who had the episode worked for Estes Express Lines and he experienced a prior seizure three weeks before the car accident, according to The Commercial Appeal. A physician allegedly cleared him to continue driving, but then testified that he was not informed of the earlier seizure.

The U.S. Department of Transportation prohibits a truck driver suspected of a seizure from continuing to work for up to ten years. The plaintiffs claim that Estes was obligated to stop the truck from working after his seizure and their failure to do this led to Roy Johnson Jr.’s death.
