Sydkraft applies for review and stay of execution order in the Supreme Administrative Court

Sydkraft applies for review and stay of execution order in the Supreme Administrative Court Today, Monday, October 18, 1999, Sydkraft will submit an application for review of the Supreme Administrative Court's decision regarding the Barsebäck nuclear power plant issue. Sydkraft wants the Supreme Administrative Court to reconsider Sydkraft's plea that the Swedish Government's decision to shut down Barsebäck 1 contravenes the Swedish Constitution and EC law. The Supreme Administrative Court has not examined all of the objections lodged by Sydkraft. The Supreme Administrative Court also neglected its obligation to request an advance ruling from the European Court of Justice. "We must do everything in our power to protect Sydkraft's interests - and those of the company's owners and employees. That is why we are taking this extraordinary measure," says Sydkraft's Chief Executive Officer Lars Frithiof. "At the same time, we are submitting an application for stay of execution while the Supreme Administrative Court reexamines this matter. "Since it is clear that our ownership rights are not being respected in accordance with Swedish law and with the provisions that exist under EC law, and Sweden's highest administrative court has not requested an advance ruling from the European Court of Justice in a matter as complex as the Barsebäck issue, we must continue to assert our legal rights. "A national court such as the Supreme Administrative Court cannot itself examine a case, the substance of which has never been examined before, much less interpreted by the highest court in the EC. The European Court of Justice reserves the right to examine all such cases in order to obtain uniform treatment of EC law." In August 1999, Sydkraft submitted an application to the European Commission regarding the Swedish Supreme Administrative Court's handling of this matter and now, in October, has applied to the Stockholm City Court for a stay of execution. The European Commission and the Stockholm City Court have requested that the Swedish Government respond to Sydkraft's applications by October 27 and October 25, respectively.
