Advocate General Opinion supports Tetra Laval On 25 May 2004 the European Court of Justice's Advocate General presented his opinion on the Commission's appeal against the judgment from the European Court of First Instance, which annulled the Commission's prohibition of the acquisition of Sidel by Tetra Laval. The Commission's appeal is directed at issues of legal principle, such as the amount of convincing evidence the Commission must bring if it wishes to block mergers under its jurisdiction. These issues are important for future practice under the Merger Control Regulation. - We are pleased to learn about the Advocate General's Opinion, which supports the conclusions of the Court of First Instance.
